Dinesh Parshad Raturi had bought a pair of shoes from Bata India Ltd. in Chandigarh for which the shop made him pay up Rs. 3 for the carry bag in which the shoes were packed.
He complained to the District Consumer Disputes Redressal Commission in U.T. Chandigarh against Bata India Ltd. The Commission President Rattan Singh Thakur found Bata India Ltd. guilty of unfair trade practice in charging Rs. 3 for the carry bag.
He said the buyer was giving Bata India free publicity by using their carry bag printed with their advertisement on it. Plus a carry bag was an essential item with the sale of the shoes, hence it was wrong to charge any customer for them.
The Forum ordered Bata India to hence forth give carry bags free to all their customers in future. It also ordered Bata India to refund Rs. 3 to Dinesh Parshad Raturi along with Rs. 3000 as compensation for causing him mental and physical agony, along with Rs. 1000 as costs.
Bata India Ltd. was also asked to deposit a punitive damages of Rs. 5000 in the Consumer Legal Aid Account.
