Vikas Aggarwal and Yash Garg bought a medicine called Paracip 650 mg. from Apna Chemists in Chandigarh for which they were charged Rs. 108. But they found out that the actual price (Maximum Retail Price) was only Rs. 18! They had been charged 10 times more by this shop!
They complained to the District consumer Forum in Chandigarh which sent its notice to the shop Apna Chemist which did not appear for the court hearing. The Forum found it guilty and ordered it to refund Rs. 108 and pay up Rs. 10,000 each to the complainants for mental agony and harassment. It also had to pay them Rs. 5000 each as costs of the complaint and to deposit another Rs. 10,000 each as punitive damages in the Consumer Legal Aid Fund account maintained in the name of the Secretary, State Consumer Disputes Redressal Commission.
The shop then went in appeal to the State Consumer Disputes Redressal Commission claiming that its employee had made a mistake and charged the extra amount. But the higher court dismissed its appeal and upheld the order of the lower forum forcing the shop to pay up the amount as ordered.
