Agarwal Packers & Movers? Not Again?!!!! Don’t they take any household goods home?
An elderly couple from Bangalore who had a dismal experience with the services of Best Agarwal Packers & Movers, in Bombay, to shift their household goods to Bangalore, have been helped by the Bangalore First Additional District Consumer Disputes Redressal Forum Shantinagar. Its President Mr. H.R. Srinivas has ordered this firm also calling itself Home Packers & Movers Door to Door Service, to pay up Rs. 50,000 as compensation to the couple. Court order on April 21, 2018.
Mr. S. Diwakara and his wife Mrs. Sucharita Diwakara, from K.R. Puram, in Bangalore, aged 72 years, had first agreed to pay up Rs. 23,000.
But when the firm’s employee Satish Singh, along with packers, came to collect their goods, he insisted that it would cost them Rs. 46,686 as the material to be packed and transported was much higher. He also took Rs. 6000 as insurance. They unfortunately paid up Rs. 1800 as a tip.
The goods arrived in Bangalore very late and to make it worse, Best Agarwal Packers & Movers refused to unpack the goods or to help with shifting them into the house though this had been agreed upon when the extra amount had been paid. The elderly couple went through hell trying to find help elsewhere to get their household goods inside. Calls made to this firm were ignored. Emails too were ignored. They had to spend extra money to shift their own household goods.
Remember never to tip Packers & Movers in advance! Wait till they bring your goods home first!
They finally complained to this Forum which found Best Agarwal Packers & Movers guilty of deficient service in several counts: 1. For not delivering the goods in time, 2. For not unpacking and shifting the goods into their home, 3. For breakage and mishandling and spoilage of many of their goods 4. For taking money for insurance and not giving them the necessary documents for this, 5. For damaging several items amounting to Rs. 40,000. 6. For collecting GST without informing them the registration number for it. The goods were delivered five days later than they should have been.
Best Agarwal Packers & Movers did not even bother to come to the consumer forum which ordered them topay Rs.6,000/- collected towards insurance, a sum of Rs.10,000/- towards delay in delivering the goods and a sum of Rs.10,000/- towards not unpacking the goods and Rs.50,000/- towards mental and physical harassment.
The firm has also been ordered to pay up Rs. 25,000 as costs to the couple. It has to pay up all this money within 15 days of receiving this court order.
Agarwal Packers & Movers harass and ruin household goods of consumer from Ahmedabad
In a second case involving Agarwal Packers and Movers, the Udupi consumer forum has come to the aid of a consumer whose computer vanished when this firm brought his goods from Ahmedabad to Udupi.
Sandeep J. Shridhar, a software engineer in Ahmedabad made the mistake of engaging the services of Agarwal Packers & Movers to transport his goods to Udupi in September 2016.
The firm which had promised to send 4 delivery persons to help with the packing of his household goods like furniture, television, computer etc. sent only two men and so he had to help them to do their work for packing for which he had paid this firm Rs. 44, 325.
Then they sent a very small vehicle instead of the large one promised which caused immense hardship in stacking up all his goods. The firm also did not let him get insurance, claiming that it was a renowned and reliable firm so he should save his money and not use it for insurance.
Unfortunately, everything went wrong in this transaction. At the time of collection on 27-08-2016, they had promised that the goods would reach him within 8 to 10 days. But it arrived some weeks later on 10-9-2016! To add to his horror, the goods were damaged and the 24 inch LED computer monitor worth Rs. 13000 was missing from its box! In its place were several cardboard sheets, Agarwal Cartons torn and stuffed in the carton! The fridge, washing machine and motor cycle were all damaged, having taken so long to arrive.
He complained to the head office of Agarwal Packers & Movers Secunderabad, then to Satveer Choudhary, Territorial Head, Agarwal Packers & Movers, Ahmedabad and also to Harinath Tiwari, Agarwal Packers & Movers, Mangalore.
They all promised to investigate the matter and get back to him. But 8 months later nothing happened. He finally complained to the Udupi district consumer disputes redressal forum which found the firms guilty of deficient service, causing unfair trade practice and harassment of the consumer.
Forum President Shobha C.V. ordered all three firms to pay up Rs. 30,000 as compensation for all their misdeeds to Sandeep along with Rs. 5000 as court costs.
Complaint no. 70/2017
Agarwal Packers and Movers harass another consumer
M.L. Bhardwaj Chief Manager of Vijaya Bank, Bangalore had availed the services of Agarwal Packers & Movers & ANR to pack and move his household articles from Bangalore to Zirakpur near Chandigarh. He paid up Rs. 69, 398 to them. But this was not a good choice.
First of all Bhardwaj was horrified to discover that all his goods arrived badly damaged and drenched in rainwater! Then his car arrived very late and he had to spend extra money for private transport!
He complained to the district consumer forum where Agarwal Packers& Movers did not show their face! The district forum which found them guilty of deficient service, causing mental agony and harassment to Bhardwaj ordered them to repay Rs. 69,398 to him along with Rs. 50,000 as compensation and litigation costs.
Aggrieved by this order this firm appealed to the Punjab State Consumer Disputes Redressal Commission which dismissed their appeal. Then they approached the National Consumer Disputes Redressal Commission New Delhi which also dismissed their appeal!
While there are many online consumer forums, your best choice would be the Government forums. You can even file your complaint without engaging a lawyer.
Do not trust a private online firm that asks you to pay for their services.
Contact the consumer forum in your town and it will give you complete information on how to file your complaint. It will answer all your queries for free, which the private firms will charge you for.
Most consumer forums will resolve the issue within one to four months.
If you are not satisfied with the amount of compensation given you can go in appeal to the State consumer forum and then to the National Commission in Delhi. You can also file a separate civil suit in the civil court.
If you have suffered from a fraudulent deal you can file an FIR alleging fraud at your nearest police station.
Remember to deal with the firm through letters and emails so you have enough proof to file your complaint.
Do not tip the packers, especially before hand as Mr. S. Diwakara had done! Get it in writing that your goods will be delivered safely at your place.
Do not trust your valuables like jewels, laptops, expensive goods of any kind that you can transport yourself.
Make a detailed search online before you choose a packer and mover. Word of mouth also helps.
Ask these vital questions:
1. Are you a licenced company. Do you have a permanent address.
2. are you willing to put your commitment in writing.
3. Are you doing it yourself or are you subcontracting the job.
4. Do you have liability insurance in case of mishap etc.
5. Are you willing to pay up in case of damages, accident, theft etc.
6. read all the terms and conditions in the written document carefully.
