Bata India ordered to pay compensation to Mysore consumer still waiting for his shoes to arrive
- Sandeep Guptha of Mysore, had ordered a pair of Power Kinetic Voltage Black Training Shoes, size 11 on 20-11-2017 online from Bata India, paying Rs. 2499 for them. The shoes arrived on 22-11-2017 but they were size 8! He requested Bata to exchange them.
Bata India told him to return the shoes to Bata Retail Distribution Centre in Bangalore and promised to send him the replacement. He sent the shoes by Blue Dot courier to the Bata Retail Distribution Centre in Bangalore and then waited in vain for the replacement!
After several attempts and complaints, Bata did not respond and Sandeep complained to the District Consumer Disputes Redressal Forum in Mysore. Bata claimed in the Forum that first of all Sandeep had not returned the shoes in question as ordered and secondly the Mysore consumer forum did not have the jurisdiction to settle this complaint as the issue was online.
But Forum President H.M. Shivakumara Swamy ruled that as Sandeep had paid for the shoes in Mysore, the Forum had the jurisdiction to resolve the matter. Bata India had also received the shoes as Sandeep had proven.
Finding Bata India guilty of deficient service and harassing a consumer, the Forum President ordered it to refund Rs. 2499 to Sandeep along with interest at 18 per cent, another Rs. 15,000 as compensation, Rs 2000 as costs.
