Bosch and Amazon India online store cheat consumer with false advertisement of washing machine

A consumer had bought a large, heavy and expensive Bosch Washing Machine from BSH Household Appliances Manufacturing Private Ltd. via the Amazon India online store. He was lured by all the extra features of the programs available in this washing machine, promised by both Bosch and Amazon India on their website.

But when he received the machine he discovered that many of the programmes mentioned on the websites were not available in the machine he had bought. He also had to pay extra for installation of it in his home.

When he complained to Bosch and Amazon India they did not respond properly and only urged him to buy another machine with the features that had been promised for the one he had bought!

He complained to the Advertising Standards Council of India which asked Bosch and Amazon India to respond. But they did not and the ASCI found them guilty of gross exaggeration regarding the washing machine they are selling to consumers online.

Here is what the ASCI says in its website:

The ASCI approached the advertiser for their response in addressing the grievances of the complaintrded the details of the complaint, to the advertiser with a request to respond to the same. The Advertiser was offered an opportunity for Personal Hearing with the ASCI Secretariat. The advertiser had, however, not responded to ASCI’s request. The CCC noted that no response was received from the advertiser prior to the prescribed due date for this complaint. The CCC observed that the complainant raised objection against the advertised programme features of the washing machine (model WAB16161IN) on amazon web-site https://www.amazon.in/Bosch-Fully-Automatic-Loading-Washing-%20WAB16161IN/dp/B01HM60GNK/ , as the same model purchased by him did not have many of the program features mentioned therein. These programs were also advertised on the advertiser’s website http://www.bosch-home.in/productlist/washer-dryer/washing-machines/front-loading-washing-machines/WAB16161IN#!/Tabs=section-technicalspecs/. In support of his complaint, the Complainant provided copy of correspondence exchanged with the advertiser, Copy of invoice, and Call recordings. As per call recordings, the Bosch representative indicates some features to be present in the specific model ( Speed Perfect, anti-vibration side walls, Manual Drum clean using Cotton 40 program, Quick Wash, Super 15 / 30, Pre-Wash) and later admits that Super 15/30 feature not being there. In another call recording Bosch representative admits to the error on the web-site regarding the advertised program not being available for the model purchased by the complainant (in particular Quick 30). The CCC viewed the website advertisement and upon careful consideration of the complaint, and in the absence of any comments or response from the advertiser, and based on the evidence provided by the complainant, the CCC concluded that the advertiser’s website as well as the Amazon web-page claiming the programme features, “Special programmes: Monsoon (Freshen-up) Super Quick 15min / 30 min, Hygiene, Kidswear (Extra clean), Delicate (Silk), Wool (Gentle handwash), Synthetics, Drum Clean,”, were false for the advertised Model WAB16161IN Series 2 Front Load Washing Machine, and is misleading by gross exaggeration. The website advertisements contravened Chapters I.1 and I.4 of the ASCI Code. The complaint was UPHELD.” ”

COMPLAINT:

““World’s First Phone with mosquito away technology” ”

NATURE OF COMPLAINT:

“1. Please substantiate the claim with claim support data. The data should have third party validation. 2. Are there no harmful effects of the mosquito repellent technology on the user since unlike other repellent devices this product comes in frequent contact with the head and ears? Please substantiate with independent claim support data. 3. The advertisement shows a child with the phone. Is it safe for such a device to be used by a child? Please substantiate. According to us, the advertisement contravenes Chapter 1.1, 1.2 and 1.4 of ASCI code. Action to be taken: We propose that the advertisement should be immediately withdrawn”
