Ambasa, a disabled person from Hubli purchased a Micromax BW1 81 Mobile from Bhandage’s Mobile World in Dharwad. Within a few days the set started giving trouble with the touch screen, battery backup and mother board. So he got it checked by an authorized Service Centre of Micromax, Sri Raghavendra Enterprises, Hubli which returned it claiming it would work smoothly.
But the set did not work and he had to take it back many more times and each time they returned it to him in a bad condition! He finally asked the shop, Bhandage’s to return his money.
Being a disabled person it was not possible for him to keep returning to the service centre which was an authorised one of Micromax Informatics Ltd. Gurgaon . But Bhandaje’s told him to either contact Micromax or the service centre as they could not help him. The problem was with the mother board but both shops refused to change it. He finally complained to the DISTRICT CONSUMER DISPUTES REDRESSAL FORUM, DHARWAD. Its President, Smt.C.H.Samiunnisa Abrar, found the shops guilty of unfair trade practice and deficient service towards a handicapped person and ordered the Micromax Informatics Ltd. service centre to repair the mobile within 15 days, failing which both shops should pay Rs.10,902/- to the Complainant with Rs.4,000/- (Rupees four thousand) towards mental agony and harassment and Rs.1,000/- (Rupees one thousand) towards litigation charges to the disabled complainant.
