Anurag Sharma had paid up Rs. 63,000 to Vivek High School in Chandigarh to get his daughter admitted to the nursery class. But before she could join, he was transferred out of Chandigarh and requested for a refund of his money. The school however only refunded Rs. 30,000 saying that they had mentioned in their fee book that administrative charges are not refundable.
He complained to the Chandigarh district consumer disputes redressal forum which ordered the school to refund the remaining Rs. 30,000 with another Rs. 7000 as compensation for causing him distress and another Rs. 5000 as costs.
The school principal went in appeal to the higher court, The State Consumer Disputes Redressal Forum, claiming that this was not a consumer related case and hence it should be dismissed. But the President of this Forum, Justice Jasbir Singh (Retd) also ruled in favour of the child’s father and ordered the school to follow the order of the district forum and pay up all the dues to the consumer.
